M&S Remove Jimmy Choo Look-a-likes

It is a fine line between what the designers showcase and what the high street shops have in store.

The high street gets it’s inspiration from the designers at the top and the designs are then filtered down to the public so that they can wear catwalk look-a-like clothes at a fraction of the price. I do honestly feel for the designers who have originally come up with a certain style and look or idea and then a few months down the line we will see an exact copy on the high street. Of course it’s good for the public to be able to replicate the same look that they see on the catwalk but who can really police this and put in place a copyright ruling?

Marks and Spencer (M&S) has been forced to destroy a popular selling handbag after designer Jimmy Choo claimed it infringed a trademark.

Jimmy Choo, famous for its shoes noted in Sex in the City and The Devil Wears Prada, claimed the £9.50 M&S satin bag (pictured) was too similar to its £495 silk satin Cosmo evening bag.

The High Street retailer was forced to pay an undisclosed sum in order to end the row.

However, M&S is believed to have already sold a large quantity of the handbags as they featured in the stores’ 3 for 2 Christmas deal campaign. The bag could now become a collector’s item.

A statement agreed by the two firms said: “Jimmy Choo and Marks & Spencer have reached a confidential financial settlement, to the satisfaction of both parties, involving a design right dispute.

“The handbag has been removed from sale by Marks & Spencer, with no admission of liability.”

The legal action highlights the thin line in the fashion industry between legitimate borrowing of ideas and infringements of intellectual property.

The case is the latest reported in a string of legal actions by designer against High Street brands including New Look, Primark and Kookai.

The news is another blow for M&S this Christmas as a member of staff at store was recently caught selling alcohol to a 15-year-old girl in an operation carried out by trading standards officers.
